Petition to the Kaiser re: the Steward

Post by b3n|<3r|\| »

Recent discussions in the judex have prompted this petition. I ask that with the approval of the Kaiser and the Praetor obv that Article I Section D of the Imperial Charter be amended to be in line with the following post:
IMO, "ruling Steward" is interchangeable with "Steward". We ought to clarify that too to make sure nothing goes awry in that regard. I think the Steward should be either a) appointed when the Kaiser goes on leave b) appointed when he ain't so if the Kaiser leaves for a period of time unexpectedly we've still got one. The Steward ought to have no powers unless the Kaiser is on leave. The Kaiser ought to be automatically on leave if he doesn't post for 2 weeks. Any of that in the charter? If not, "put it in! put it in!" :document
so as to avoid any unnecessary complications and so on.

I would just legislate this (or give it to a Duke to be legislated rather) but I think it's best if this issue is dealt with at the heart of Shireroth's law.

I remember a tradition that the Kaiser only modifies the Charter when a complete overhaul is to take place. Regardless of whether this tradition is still kept, I think we ought to make an exception to avoid as I say any issues that may arise in the future.

F&B may be retained to draft possible changes to the Charter, DecreeBook and LawBook. We have a forum, please use it. :D

As I see it, the issue has been dealt with in the Judex, and no law need be written.

We will take this matter under advisement. I'm inclined to do exactly as benkern asks, but I'm loth to mess with the charter often.

Err. Yes... but traditions...
From a distance I'm concerned about the rampant lawyerism manifesting itself in Shireroth currently. A simple Kaiserial slap on the wrist or censure by the community should suffice. - Jacobus Loki

The fact is, the charter IS clear on this. It makes no provisions for our unofficial usage of the term "Rung Steward", a historical rarity to be sure. It states clearly that the Steward cannot change a decree of the Kaiser. The Judex has seen this matter and clarified the perceived misconception; that we ourselves created I admit.

However, the Steward can edit the Lawbook, and as we keep most relevant law in there, this prevents a lot of problems. If Kaisers were to keep with editing the Lawbook, then that would prevent the need for Stewards to need these extra powers.

Also, the Decreebook is itself not a decree, so it might be permissible for a Steward to edit it. The Judex would have to review the matter. Although as I consider what's in the Decreebook, this becomes more unlikely, nevermind.

If we gave a steward access to decrees, he could in theory, nullify who the next heir should be and either himself take the throne, or allow for another to do so. Putting the Steward on par with the Kaiser, in such a regard, gives the Steward more power then he ought to have. The Steward should Never be able to challenge the Kaiser.

As things sit, the steward can take risks. If the Kaiser (or next Kaiser) supports him, he is OK. If not, he's bantha fodder.

Perhaps codification of "Ruling Steward" is in order, with the proper safeguards?

I like to think of the Steward as a Kaiser stand-in, like a caretaker government, and a ruling Steward as a placeholder until we get a Kaiser. I deeply dislike when Stewards pass decrees while there is a ruling Kaiser who is not on a LOA for example. The Steward is a servant of the Kaiser, nothing more, nothing less.

IMNSHO, the Steward is the servant of the Kaiser and of the Empire and the people. Sometimes those duties and responsibilites are not clear and sometimes those duties appear to conflict.

I do not want the Steward to shake in his boots out of fear of doing something, or for the Empire to fall into the doldrums or worse during a Kaiserial LOA, or when a Kaiser is passive or distracted.

A Steward should keep the Kaiser on his toes, so to speak.

(Corey, you may take that as policy during my reign.)

Do recall that the argument which prompted this was on whether a Steward could change the decrees of any Kaiser other than the current one. Even under that he still couldn't change current ones, hence, no changing heirs or anything.

If the Kaiser was "dead" he could. Corey could, in theory, have changed the heir from Loki to anyone else.
