The Inquisition.

Post by Erik Mortis »

So, as the head of the Judex. I need 2 (at least) Inquisitors. One to act as standing defense and one for standing prosecution/Investigator. Or they can trade off.. which ever.

Anyone interested?

I accept, I'll support whichever one's in the right.

If neither are, the one that pays the most ...

So who wants defense, and who wants prosecution... or shall we just trade off.

hmmmm.... wait.. if they are being payed by the people.. why am I hireing them..

Though my plan was to have them double as investigators. So they do the lawyer and the police work. Inquisitors!

Maybe the Judex could get some funds, and I could pay them for legit cases they bring before me. ie. Prosecution is payed by the court, and defense by the defendant. Though this does give the incentive to people to sue others, or bring cases before me. Free lawyer...

Does this "Inquisition" work have any limits on what is and is not acceptable? It'd be nice to know.

Explain. Acceptable cases to bring before my court? or what you are allowed to investigate, or put on trial... or how you investigate.

Remember, there are no Rights in Shireroth. So, keep that in mind. If you do something I don't like, or isn't legal.. then I'll say something, till then. We're making up the rules for the first time.

A word of Caution.

I was involved in a nation that had an active judiciary. It got very active, and soon it was used to hound not only "rebels" :) , but political opponents, and soon after that it was used to arrest and/or sue anyone who did anything.

Needless to say, no one stayed in "jail" for very long at all. It also created a raft of alternate log-ins, (although I'd know nothing about THAT).

Anyway, my point that an Inquisition must have a light hand.

On the other side this is Shireroth, and the Arbiter is Erik, so I will set my paranoia on medium low.

P.S.- They had an idea in Morovia about trying cases involving "fictional" characters, in order to to frighten the populace.

Well, there is a tradition in shireroth of observing the spirit of the law over the letter of the law. So people don't tend to get taken to court over technicalities. And I plan to write some Judicial Precedures as we need them. Since the Inquisitors answer to me, I can restrict their behavior. and I report to the Landsraad (and sometimes the Charter), so there is oversight for me.

You don't need to worry about me, Jacobus. My experience is from a micronation that, while it takes the court case seriously, doesn't take the crime or punishment bit too seriously. I think the citizen that's been in court the most times is our very own Chief of Police. Virtually everyone knows that though we play them 'seriously' our court trials are just for fun ... and so I don't think there's much chance I'd be taking political opponents seriously to court or anything.

On the flip side, I like to support the people in cases that are in the right already. Which makes prosecuting political opponents a little hard ... from a justice perspective ...

It's more of HOW are we allowed to investigate. At some point in the investigation, is there a limit as to how far, how extreme we may get to find the truth? Like, is there a cap on torture, is there a cap on invasion of personal privacy, etc.?

NO ONE EXPECTS the Spanish Inquisition!

I was thinking more Mel Brooks in History of the World Part I... Where the inquisition was a song and dance routine with nuns doing synchronized swimming. :D

So what would a humble foreign individual have to do to end up in the clutches of the inquisition?

What?

I'm curious about the methods and I'd like to know first-hand! :D
