Praetor powers and impeachment

Post by Kaiseress Semisa I »

Article 3

From:
Section A: Basic Powers of the Prtor
Clause 1. The Prtor shall be vested with the basic power outlined within the Imperial Charter.
Clause 2. The Prtor is empowered to represent the cause of law and order under the Kaiser in the Landsraad.
Section B: Express Powers Granted to the Prtor by the Landsraad
Clause 1. In the case of bad behavior and/or abuse of the Landsraad by any noble or minister, the Prtor may levy a fine of up to 15 against the disruptive noble or minister. Alternately the Prtor may submit a recommendation to the Kaiser for, banning, or otherwise punishing the perpetrator. The Kaiser may, as usual, do what he wants with such recommendations. Weather the Prtor chooses not to make such a recommendation it is NOT within his powers to take any punitive actions beyond the per-mentioned fine.
Clause 2. In the event of a tied vote in the Landsraad, where all nobles have voted, and where the full voting time for the vote has been extended, the Praetor may be granted two additional votes to break the vote, in the interest of law and order in the Imperial Republic. These two votes must be cast as a Yea or a Nay vote, and may not be cast as Abstains.
Clause 3. The Prtor may voice their opinion on a piece of legislation in the Landsraad, and may propose changes to it.
Clause 4. In the case of a bill having been submitted in improper format, the Praetor may reformat the bill to facilitate its inclusion into the Lawbook or the Landsraad Procedures as necessary. The Praetor must get the approval of the bill's original sponsor on the reformatting before it becomes official.
Section C: Express Powers Denied to the Prtor by the Landsraad
Clause 1. The Praetor may not ordinarily vote on legislation unless he or she is a noble.
Clause 2. The Praetor may not incite others to vote one way or another, or demand that votes be changed one way or another.
Clause 3. The Praetor may not incite rebellion against the Kaiser in the Landsraad, under threat of impeachment.
Section D: Appointment of the Prtor
Clause 1. The appointment of the Prtor shall comply with the rules for appointment of a Prtor as set down by the Imperial Charter.
Section E: Removal of the Praetor
Clause 1. The Prtor may be impeached at any time before his or her term is up by a supermajority of 67%. This impeachment vote will be moderated by the Kaiser, and will be closed to votes from the Prtor him/herself if the Prtor is a ruling noble. If the vote passes, a new election for Prtor shall immediately be organized by the Kaiser to be held not more than seven days after the impeachment bill passes. The Kaiser may also choose to dismiss the Prtor, after which he will be similarly responsible for organizing an election for a replacement.

To:
Section A: Basic Powers of the Praetor
Clause 1. The Praetor shall be vested with the basic power outlined within the Imperial Charter.
Clause 2. The Praetor is empowered to represent the cause of law and order under the Kaiser in the Landsraad.
Section B: Express Powers Granted to the Praetor by the Landsraad
Clause 1. In the case of bad behavior and/or abuse of the Landsraad by any noble or minister, the Praetor may submit a recommendation to the Kaiser for removal of status, removal of territory, removal of voting power, banning, or another punishment. The Kaiser may, as usual, do what he wants with such recommendations. The Praetor, though granted the ability to recommend, is not granted the ability to punish in any instance.
Clause 3. The Praetor may submit bills, voice their opinion on a piece of legislation in the Landsraad, and may propose changes to existing legislation.
Clause 4. In the case of a bill having been submitted in improper format, the Praetor must reformat the bill to facilitate its inclusion into the Lawbook or the Landsraad Procedures as necessary.
Section C: Express Powers Denied to the Praetor by the Landsraad
Clause 1. The Praetor may not vote on legislation unless he or she is a noble or is granted tie breaking votes as defined in Article III, Section A, Clause 2.
Clause 2. The Praetor may not incite others to vote one way or another, or demand that votes be changed one way or another.
Clause 3. The Praetor may not incite rebellion against the Kaiser in the Landsraad, under threat of impeachment.
Section D: Appointment of the Praetor
Clause 1. The appointment of the Praetor shall comply with the rules for appointment of a Praetor as set down by the Imperial Charter.
Section E: Removal of the Praetor
Clause 1. The Praetor may be impeached at any time before his or her term is up by a supermajority of the Landsraad of 67%. This impeachment vote will be moderated by the Kaiser, and will be closed to votes from the Praetor him/herself--if the Praetor is a ruling noble. If the vote passes, a new election for Praetor shall immediately be organized by the Kaiser to be held not more than four (4) days after the impeachment bill passes. The Kaiser may also choose to dismiss the Praetor, after which he will be similarly responsible for organizing an election for a replacement.
Reason: Myriad changes involving time lengths. Clarification of procedure. Grammar edification. Additional powers granted the Praetor in the case of having to rewrite a piece of legislation (that of being required to rewrite a piece of legislation not in proper format; and that of not having to ask the original author for approval of the final product.

I think the Landsraad by itself may "silence" a member, if s/he does something wrong

Overall, seems good. A little uncertain about the Praetor not being able to punish at all, but I suppose it's just as well... the fines haven't been used in ages.

The fines were useless in the first place, but I still think the praetor shouldn't be able to punish. So this works for me. There are no flowers, no not this time. There will be no angels gracing the lines, just these stark words I find.

Ok, I see something that might need clarification in Section E, Clause 1. It says that the Praetor may not vote on his own impeachment, if a ruling noble. However, should his duchy's votes then entirely be uncounted? Perhaps those votes should be redistributed somehow within the duchy, for that vote.

Could be done, but then you might run the risk of the noble's subordinates (who would most likely be the recipients of the redistributed votes) being under the noble's sway during the impeachment.

This is true, but perhaps the vote distribution being out of the noble's hands? Like they're distributed by the Praetor or the Kaiser? I mean, I think that it's important we entirely don't deny a duchy votes on an important matter because of bias...
