While I believe this Constitution is an improvement from the last time, the only inherent flaw is that there is no supremacy in the Constitution. The Kaiser, since the Constituion is ratified by decree not popular vote, is essentially above the Constitution thus making the Constitution just that in name. Just mindless ramblings

We need some way for the Nobles to have some power over the Kaiser should the need arise. I've got it - here it is. You know that part about the Kaiser being able to disolve a Duchie or Barony - why not say only if the Kaiser can get 8 or 10 times the number of people who post against it to post they are invading Duchie or Barony and these post have to in that forum. After all, in a real feudal society something like that would have had to happen. You know, the Kaiser would have to send in the troops.Could have to be the same way for taking land away from someone.Austi ScotMinister of Visions Edited by: Austi Scot  at: 10/11/03 9:33 pm

Quote:And it's not a loop hole... the constition makes no provision for ammendment. BUT! The first constitution was lay down by Imperial Decree. Thus, the constitution is an imperial Decree, so, ONLY the Kaiser can edit it. False. It is true that there is nothing in the constitution providing for the Amendment of the consitutionIt is also true that the Kaiser is provided the power to "make any decree regarding the operation, behavior and functions of Shireroth as well as any actions he/she deems fit"However, these decrees may not violate the constitution.Neither is there anything in the constitution providing that the Kaiser may revoke Imperial Decrees. Therefore, as the ammendment or removal of the constitution would violate it, this constitution is permanent, and cannot be legally changed or revoked. This is the reason that nations generally have a Committee to work on the constitution. The only way I can see this problem to be averted would be for the loophole which I believe I pointed out. However, I would be disappointed if our Kaiseress used the loophole herself, it being a sneaky and devious way out. Also, as it was mentioned, there need be some check against the Kaiser, I believe the Editing of the Constitution may be the closest we have, so let us not take it away. If we would change the constitution, let a bill be placed before the Landsraad, and upon its proposal, let then the Kaiser decree it Constitutional or Unconstitutional, in accordance with his supreme Judiciary power. Then let the Nobles of the Imperial Republic of Shireroth decide if it be best. Raised by a family of Griffins in the forests of Llanowar, this young mage is rumored to be the sole male born of the Serra tribe.Edited by: Gryphon the Pure at: 10/12/03 10:01 am

Revoking a decree, is more or less the issueing of a new Decree. and New Decrees replace Old Decrees. The Kaiser, Mors I(proly).. set down the current form of the Constition, the one we've run under for a long while.. By Imperial decree, the COnstition is an Imperial Decree. Thus can be overwritten by an Imperial Decree. don't aurgue.. I wrote the constition.. I know what it is supposed to say... What it means. The Kaiser Is supreme above all. This is NOT.. get it straight... NOT.. a democracy.. This is a dictatorship, a Monarchy. This isn't like all those bloody DD nations.. We have been a monarchy for over 2 years.. and we aren't changing.... And another thing.. The constitution, Is NOT supposed to be a tell all structure ect..whatever for the nation, it is NOT supposed to be like the US constitution. it is basicly... a rough outline of the government for people to refer to. Guide lines for how the nation is run.It doesn't dictate the nation.. it reflects it... do I need to teach a class on it? When things are added to the constition, it's cause they were already in place. Now, I'm done here... Erik Mortis BrookshirePrætor of ShirerothDuke of Brookshire

I see what you mean. But the constitution should be the one to say that, not the writer thereof. In accordance with that, I think there should be at least in the constitution a layout of the judicial system of laws, since constitutional means nothing unless there is somebody to find it so. But anyhow... I think that's all I'll argue for now.Oh, and since I am not allowed to post at the hearing right now, I guess it would be the time to say that I would be representing Gryphon. Not only must he have time to heal and sort out his troubles, but he also feels unsafe in the public world. He has sent me on his behalf. I know his mind, and I shall speak it for his own. But he will not show face here for awhile. Please take this into account, and allow me to be heard... Let's get ready to RoX0Rz!!!

Perhaps for the sake of clarity, the part that says "The Kaiser may make any decree regarding the operation, behavior and functions of Shireroth as well as any actions he/she deems fit as long as they do not violate this constitution" should be changed to read "The Kaiser may make any decree regarding the operation, behavior and functions of Shireroth as well as any actions he/she deems fit even if they violate this constitution." Otherwise it's just asking for trouble.
