Stewards Decree #362: Concerning the Steward

By the will of the great sheep and the people of Shireroth,

In light of the vote that has recently been passed in the Landsraad and the absence of the Kaiser, I herby appoint myself Imperial Steward of Shireroth until either approved or revoked by his niftiness the current Kaiser when he returns.

Note: Please ignore just how circular the legality backing this decree truly is...

Well actually if I may draw your attention to the Imperial Charter:

Section E:
b) A steward shall be appointed by the Kaiser or Landsraad should the Kaiser take temporary leave of zir throne.

The Landsraad vote can make you Steward, but you can't decree yourself Steward. Observe:

Leo(NotSteward) Does not have the power to make decrees
Leo(Steward) Does have that power

Therefore Leo(NotSteward) cannot make a decree even if that decree would make him Leo(Steward) because only Leo(Steward) can make decrees at all.

Leo(NotSteward) is elected to Sort of Stewardship by Landsraad. However there is no Imperial Decree legalizing this action so Leo(Steward by Charter and not by Decree) Decrees it to be so!

Thats how I see it at least. :p

Leo(NotSteward) can become Leo(Steward) without an Imperial decree legalising his appointment. I think the only other way is through election by the Landsraad. :document

Let me offer some legal clarification:

The Landsraad may appoint a steward (without an imperial decree) should the Kaiser take a leave of absence. He has not done so (officially). Therefore, the Landsraad still requires Imperial confirmation before Leo can be Steward (officially). However, I see no reason for His Niftiness to deny the Landsraad vote, and so I have no problem with Leo taking over while His Niftiness is on unannounced leave. But yes, you can't declare yourself Steward. I think Andreas may have been attempting to be humourous, and failed.

I will have to disagree with you on that point Allot. The way that the section of the Charter reads "A steward shall be appointed by the Kaiser or Landsraad should the Kaiser take temporary leave of zir throne." does not require the Kaiser to announce his absence (it doesn't even say leave of absence) but merely comes into action should he be away for a extended period of time. My appointment is therefor perfectly legal by the Imperial charter and all subsequent forms of law. I just formalized it :yay:

The Kaiser did give the Landsraad leave to elect a steward.

There is a slight difference between a Ruling Steward (which we hope we'll never have again since it's so untidy) and a Steward.

A Steward is subordinate to the Kaiser, just like the Steward of Elwynn. A Ruling Steward is appointed in the event that there is no heir to the Mango Throne, so the Steward rules like the Kaiser until a Kaiser can be found.

A Rulling Steward has all of the power and authority of a Kaiser. He is restrained more by custom and fear of the succeeding Kaiser-to-come than by law.

Ruling Stewards have been crucial to Shireroth. Steward Corey, Steward Celestius and of course Steward Nikkolo I of Oustfest fame have been as important to our history as any Kaiser.

Rule with Justice, Steward Leo, and history will group you with them in fame and honor!

I agree that they have been important, but the Ruling Stewardship is an unwanted anomaly. But the issue is rather moot, since Leo is not a Ruling Steward.

A - The Kaiser is missing.

B - Leo is Steward.

C - Therefore, unless Erasmas is found, Leo Rules as Steward.

Admittedly, it's a clumbsy solution, but it is backed by law, history and custom.
