The Council of State is a formal body composed of the most senior government ministers chosen by the Governor General, and functions as the executive branch of the state. With the exception of the Governor General, all members of the council have the title Chancellor, if head of a government department, or minister, if a junior minister in a department. Since the executive power is explicitly vested in the Governor General, the Council of State functions primarily as a deliberative and consultative body. The Governor General also delegates certain powers to each individual chancellor.
Constitutional basis
The executive power is vested in the Governor General, not the Council of State. The members of the council are appointed by the Governor General and serve at their pleasure. All decisions of the council have to be signed by the Governor General to come into effect. The constitution requires that all decrees are first discussed in the Council of State. The most senior staff of the civil service belong to the State Chancellery and are organized into different departments supporting the Council of State, headed by the most senior members. The distribution of responsibilities between the various department of the chancellery is decided by the Governor General.
Functions and mandate
The Council of State convenes to deliberate and issue decisions on matters of state and policy. All decisions finally rest with the Governor General. However, the power of the Governor General depends on their ability to control their party and the majority in the National Assembly.
