Recognize Novaya Zemlya

Novaya Zemlya's been around on and off for a year, contains two former Shirerithians (Krasniy Yastreb and Aurefiction) and is one of the niftiest countries around, despite their "accidentally" crashing a satellite into our capital the other day (long story). Anyway, I say we recognize them:
WHEREAS the REPUBLIC OF SHIREROTH, having come into contact with THE SOVIET REPUBLIC OF NOVAYA ZEMLYA and finding their interests to be coincident, does desire to formalize and secure its cordial feelings, it hereby:

Recognizes the it as a sovereign and independent country, possessed of all the rights entailed thereby;

Recognizes it as the sole legitimate owner of all territory, both physical and imaginary, which it claims;

Commits to resolving all mutual disputes peacefully, using a neutral third partied agreed to by both should this prove impossible by normal channels;

Commits to remaining open and accessible to tourists and other visitors from Novaya Zemlya, barring national emergencies or other such security issues;

Hopes to open proper channels of communication, so as to facilitate dialogue and future cooperation.

I am seriously suprised that we have not recongized them before.

Either way, I fully support their recongition.

Recognizes it as the sole legitimate owner of all territory, both physical and imaginary, which it claims;
I know such treaties usually pass Landsraad with little or no debate, but I must bring this section of the recongition resolution. I think, perhaps unknowingly, whoever wrote this resolution has given Novaya Zemlya a blank check when it comes to claiming territory and getting Shirerithian support. What if Novaya Zemlya claims Babkhan territory, or for that matter Shirerithian territory - will we have to break our treaty with them?

This has been a standard feature of all our recognition treaties, and I believe that it simply means we recognize them as the owner of the territory they have now, as of when we pass the treaty. Thus, if Babkha were to claim one of their oblasts, we would be bound by this treaty to recognize NZ rather than Babkha as the owner, but if NZ were to claim a Babkhan satrapy after we signed the treaty, this wouldn't apply. At least that's how I read it.

How about amending it to "the territority it claims at the signing of this treaty"?

How about:

"Recognizes it as the sole legitimate owner of all territory, both physical and imaginary, which it claims and has proven sufficiently to have rightful claim to;"

Perhaps even simpler would be to add the word sovereign to the operational clause.

"Recognizes it as the sole legitimate owner of all its sovereign territory, both physical and maginary."

This seems to be a unilateral recognition, judging from its form, so at least we shouldn't have to worry about harmonizing changes in wording with the Zemlyans... otherwise I'd say let the phrasing stay as is. If we do change it, think the Kaiseress' proposal might be best... recognizing only their current claims leaves us in the position of possibly having to re-recognize if they change their claims in the future, but on the other hand it leaves us room to protest if they claim something they shouldn't (not that I would accuse the good Novaya Zemlyans of such a thing).

But I do think that this is a good idea.

Hmm... Is it unilateral? If so, why?

Delphi - uh, probably becasue they havn't gotten around to doing the opposite? :p

Eh, most treaties of recongition that I have seen had been unilaterial, but when both sides recongize each other through seperate bills, that is when it becomes bilateral recongition.

Hmm, I always used to just have a treaty that both sides sign, on the condition that both sides are signing it. A mutual recognition treaty.

I know we've done bilaterals before too... I'm guessing that this one is unilateral because it's more friendly that way. Something along the lines of "We don't even require you to recognize us back... we're just gonna recognize you, we like you that much". Or, alternatively, it might be an apology for not drawing up a treaty with them earlier. You can read all sorts of things into diplomatic statements like this. :document
