Note: This is a Personal Revision, which was never officially proposed to Kaiser nor Landsraad. It never had any legal standing, and does not affect the population in any way.Constitution of the Imperial Republic of Shireroth:Article I: The Kaiser.Section A: The KaisershipThe Kaiser of Shireroth is the Supreme ruler, and noble, of the Lands of Shireroth. The Kaisership is not restricted by gender. Kaiser shall be the legal title of the ruler, however a Kaiser may choose to be called by any title or name.Section B: Powers of the KaiserBeneath this Constitution, the Kaiser of Shireroth shall be vested with total and supreme Legislative, Judicial, and Executive powers. A Kaiser may make any decree regarding the operation, behavior, and functions of Shireroth, as well as any personal wishes. These decrees must be issued publicly and labeled as such. They shall be upholded as law second only to the Kaiser himself. A Kaiser may revoke or edit any Kaiserial Decree by public pronouncement. The Kaiser shall be the supreme commander of the Shirithian Military, the Militia, and any other armed force within Shirithian borders. Decrees and orders regarding such need neither be public nor labeled, and may be classified to such a level as the Kaiser deems fit. All Kaiserial acts must be in accordance with the Constitution.Section C: Heir to the ThroneThe Kaiser may, before the end of his reign, choose an Heir from among those eligible by birthright. Should the Kaiser die or abdicate the throne, the Kaisership shall pass to the the Heir.Section D: The StewardIn the declared absence of a Kaiser, the Steward to the throne shall act as Kaiser. The Steward to the throne of Shireroth must be a citizen of Shireroth. The Steward may be appointed by the Kaiser during his rule, and may be removed by same. The Kaiser may alternatively allow the Landsraad to appoint the Steward. There must be a Steward to the throne at all times. In the event that there has not been a Steward for one Shirithian week, the Landsraad shall convene to elect one. In the event that a Kaiser shall pass without an Heir, the Steward shall hold the Kaisership until an Heir can be found. In the event that a Kaiser shall pass without an Heir or Steward, the Landsraad shall convene to elect a Steward.Article II: The LandsraadSection A: Powers of the LandsraadThe Landsraad shall be a voting body, vested, through the good grace of the Kaiser, with Legislative powers of Shireroth. Any Bill, Act, Measure, Dictate, Statement, or Order passed or issued by the Landsraad may be vetoed by the Kaiser for any reason. Otherwise, it shall be ruled as law second only to that of the Kaiser. The Landsraad is also vested with Judiciary powers second only to those of the Kaiser. No Lansraad action may violate this Constitution.Section B: Sessions of the LandsraadThe Kaiser has the power to dismiss and recall to session the Landsraad at any time unless there is no Steward. Should the Kaiser die or abdicate the throne, the Landsraad shall be automatically called to session. The Landsraad may dismiss itself from session at any time, unless there is no Steward or Kaiser in power.Section c: Members of the LandsraadThe members of the Landsraad shall be called the Nobility. Nobles shall consist primarily of the Dukes, who rule over subdivisions of the land, known as Duchies, set forth by the Kaiser. Dukes are initially appointed by the Kaiser. Thenceforth the Dukes shall choose their own Heirs, and in the event that an Heir is not chosen by the passing of the Duke, the Kaiser shall appoint one. A Duke may pass lesser titles of Nobility unto any members of his Duchy. Such a Noble shall be granted the right to speak within the Landsraad, but his opinion is secondary to that of his Duke.Section D: The PrætorThe Landsraad may choose to elect a Prætor from among the full-citizens of the land. The Prætor of Shireroth shall preside over the Landsraad as chairman. His purpose shall be to call a meeting of the Landsraad to order, tally votes, close votes, and generally manage and keep order within the Landsraad. The Prætor must also keep recods of all Landsraad resolutions passed during his tenure. No Prætorian act shall violate this Constitution.Section E: VotesAll Dukes shall be allowed to vote within the Landsraad. Beneath that, it is the duty of the Prætor to determine voting structure. In the event that the Landsraad has no Prætor, or is unsatisfied with the voting procedure determined by the Prætor, a bill to elect a Prætor or determine voting procedure shall be voted upon by solely the Dukes, each receiving equal say, and the Kaiser acting as Prætor. If the Landsraad passes a vote concerning the voting procedure, the Prætor shall not be allowed to alter the procedure for one Shirithian week (14 days). Lesser Nobles and Ministers may be allowed to speak in the Landsraad, but the right to vote shall be determined by the voting procedure.Article III: MinistriesSection A: Creation of the MinistriesThe Ministries of Shireroth shall be vested, through the good grace of the Kaiser, with Executive powers of Shireroth. Ministries may be created and destroyed by decree of the Kaiser. Each Ministry shall be ruled over by a single Minister. Ministers shall be appointed by the Kaiser or the Landsraad, but may be dismissed only by the Kaiser.Section B: Duties and Powers of the MinistriesUpon the creation of a Ministry, the Kaiser shall issue it a charter of its powers and responsibilities. This charter may be altered by a Landsraad act or a Kaiserial decree at any time. The Ministerial charters must be within regulations of the Constitution. A Minister may make any decree regarding the operation of his Ministry or the duties it entails, providing it is in accordance with his charter. Such a decree, if it affects any of the public, must be issued publicly and stated as such.Article IV: LegislatureSection A: Heirarchy of the Lawsi) The Heirarchy of Laws shall be as follows:Quote:1) Constitution2) Kaiser3) Landsraad4) Ministries5) Dukes6) Lesser Noblesii) All laws effected by a body take precedent over the bodies below it.iii) Any body may revoke any laws effected by itself.iv) Any body may veto or revoke laws passed by any body below it.v) Any body may appeal any action taken by a body above it. Such an appeal shall be judged only at the levels equal to or above that of the body having effected the action.Section B: Judicial Effect on the Lawsi) All Kaiserial Decrees must comply with the constitution. Kaiserial decrees take precedent over all other forms of Legislature.ii) All Landsraad actions must comply with the constitution. This compliance is judged by the Kaiser. A Landsraad action which contradicts a Kaiserial Decree must be expressly supported by the Kaiser in a public manner. Landsraad acts take precedent over all other forms of Legislature.iii) All Ministerial Decrees must comply with the constitution. This compliance is judged by the Kaiser. Ministers may not make Decrees which violate Kaiserial Decrees. If a Ministerial Decree contradicts a Landsraad action, it must be publicly supported by the Kaiser or an affirmative Landsraad vote. Ministerial Decrees take precedent over all other forms of Legislature.iv) All Dukal Decrees must comply with the Constitution. This compliance is judged by the Kaiser or the Landsraad with the Kaiser having final say. Dukal Decrees may violate neither Kaiserial Decree, nor Landsraad action, nor Ministerial Decree. A Decree by a Duke effects only within the borders of his Duchy.v) Dukes may allow their lesser Nobles to make Decrees concerning their own land. These Decrees are judged and effected the same way a Dukal Decree would be. Dukes may decide the heirarchy system of laws within their Duchies.Section C: Impermanent ActionsImpermanent actions are those which are not continuously effected, such as appointment of a citizen to a position, creation and dissolution of Ministries, subdivisions, and organizations, and acts regarding the sessions of the Landsraad. Such impermanent actions must be given a time frame of effect upon their institution. If a time frame is not given, then the act shall effect only on the moment it is passed, and not thereafter, and Actions required by the act shall occur only once. Impermanent actions whose time frame has passed shall be archived rather than written into law.Article V: AmendmentSection A: Process of AmendmentThe Constitution of the Imperial Republic of Shireroth was created to last, and as such should be amended only when necessary. When such a time arises, it is concern not only of the Kaiser, but also of the people as well. Therefore the procedure for amendment shall be as follows:1) The Landsraad is called to session.2) A proposal is placed before the Landsraad as a whole by any citizen. The Landsraad then votes upon the procedure as they would a normal bill.3) If the bill passes, it shall be voted on once again, but this time by only the Dukes. Each Duke shall receive equal say, and the vote shall be presided over by Kaiser as Prætor.4) If the bill passes the second time, it is placed before the Kaiser, who then decrees it into effect.Section B: Constitutional PublicityThe Constitution shall be publicly displayed in the court of the Kaiser, as well as in the main office of the Landsraad, and of every Ministry and Duchy throughout Shireroth. Any vandalism in its exhibit shall be removed by those loyal to the Kaiser. The Constitution shall be displayed as two documents. The first document shall be a copy of the original constitution, with amendments written in below in list format. The second document shall be a compilation of the constitution along with all amendments edited into the text. These documents shall be maintained by the Prætor and Kaiser. see, that's the problem with your system - a thing has to have "Value" to get in. I can't really give you any reasons for this work's value other than it is a personal viewpoint which may be of interest to the public, or reference for politicians... the same reason for which many other books sit in public libraries throughout the world... The Charter is Supreme.Kaiser is under the Charter, but may Edit the Charter by DecreeLandsraad consists of Nobles. Passes laws conserning all aspects of the nation. Is under the KaiserMinisters. Have COMPLETE power within the relm of their ministry. Must obey the Laws and orders given by the Landsraad. Answer dirrectly to the Kaiser. Have power over nobles when it comes to matters within the relm of their Ministry.Dukes Dirrectly under the Landsraad/Kaiser. Have complete control over their Duchies. Must obey Laws set down by the Kaiser/Landsraad and must comply with regulations set down by Ministers.Barons. Same as Dukes but also have Dukes over them. Maybe I should describe it in terms of Executive/Legislatire and Judicial powers. Mortis BrookshireKaiser of Shireroth

a) It is not Fiction, it it political philosophy. I should hope you would not have to look for Plato, Aristotle, or even the Communist Manifesto in the Fiction section.b) The heirarchy in my eyes is completely linear except for the amendment of the constitution, which is simply because a constitution can't change itself. What is it you see that contradicts this?c) Wait - - are you explaining the current system, or trying to decipher my constitution? I am perfectly familiar with the current system thank you, and if you are stating it to try to change my opinion on this constitution, you can save your breath. This revision was written approximately between the dates of October 9th and October 18th, 2003, so it is not necessarily my current favourite, but I still believe it would do better than the constitution(s) we did[ have. I was telling you the system.. and no.. you don't know EVERYTHING about it.. their are some aspects that are REALLY old that people have forgotten.. The Ministers are not dirrectly under the LAndsraad. They are slightly to the side and indepentant of it. But must follow the laws. So the Ministers have complete control within the relm of their ministry unless the Landsraad says they can't (Or have to) do something. It would be Philosophy if you explained it. On its own it means nothing. Mortis BrookshireKaiser of Shireroth

dude, the thing is, those really old aspects don't exist unless people know them! otherwise, we would still be under the democratic constitution, wouldn't we? where's the vote that pulled us out of that one?So what aspects still exist that people have forgotten? I want to know how my government works.oh, and while you're at it, tell me how it is that the Ministers aren't directly under the Landsraad. what you just described seems to support that placement. Example... A Minister such as.. Trade.. Can make ANY regulation conserning Trade... ANY... unless the Landsraad says otherwise.. or the Kaiser.. You're order imples that the Ministers are also under the control of the Landsraad. When in fact they report to the Kaiser.. NOT the Landsraad. Mortis BrookshireKaiser of Shireroth

Dude, the great thing about my version of the constitution is that it makes NO implications. None. Zippo. Zero. While that is what you may infer from it, what it says is what it means. It never says that Ministers are under the control of the Landsraad. It says thatQuote:ii) All laws effected by a body take precedent over the bodies below it.iii) Any body may revoke any laws effected by itself.iv) Any body may veto or revoke laws passed by any body below it.v) Any body may appeal any action taken by a body above it. Such an appeal shall be judged only at the levels equal to or above that of the body having effected the action.Which means only that the Landsraad can still tell the ministries what they can't do (ii and iv), and that the ministries, if they don't like the Landsraad's decision, can appeal it to the Landsraad itself or to the Kaiser (v)-- oh, and by the way, in the Charter/Lawbook system we have right now, the Landsraad does control the Ministries. The job descriptions of the Ministers are part of the Lawbook, which is managed by the Landsraad, not the Kaiser. While they still answer to the Kaiser, they also answer to the Landsraad.--anything else? *puts on baseball glove* Phoenix the Risen - Dutchess of Kildare - Political Nuisance but at least She gets the job done. - Official Genkher of Gryphon Avocatio's Cool Short Sig and Gryphon the Pure's Awesome Tables! - COME BACK, STEVE!!! -"To quote a former Kaiser.... You're Fired.....kidding...Putting everything in stone is a terrible way to write a Consitutional document. Those definitions used to be in the Charter. The Landsraad may define the roles of ministries and make laws governing them. But the Ministries are part of the Executive "branch" of the nation. They are basicly assistants to the Kaiser. Joseph.. I'm really in no mood for you always thinking you know everything about this government. It's REALLLY presumptious... Mortis BrookshireKaiser of Shireroth

we just rebuilt the nation?but wasn't this nation founded under a constitution with a bill of rights and a voting system which could not be revoked except by unanimous (or at least 2/3) vote of the population?By rebuilding the nation under different principles and different leadership, aren't you doing exactly the same thing WarVoid is trying to do to Lac Glacei?Where was the vote that brought us out of democracy? Where was the vote that removed the bill of rights? Where was the vote to elect you King?If we are truly still ruled by the old forgotten laws, which live no longer in our books nor on our offices or even our minds, then why are we not still a democracy? Riddle me this. From the way you use the forgotten laws, it seems more "Until it becomes convenient" than "Until it becomes pertinent"If you wish to have us ruled by the Old laws, then bring them forth and do not call them from the dark recesses of your mind just when they need be used. If a word be law, then let law be word. Decree, my Kaiser, Decree. Heil Loki!!!
