Amending G

THAT SECTION G OF THE LAWBOOK BE AMENDED TO READ


G: On the physical person

1. Judicial capacity

a. Every physical person enjoys judicial personality

b. Every physical person holds personality rights which are the right to life, integrity of person and the respect of zir name and privacy. These rights are in good faith; they may not be exercised with the intent to injure another or be used excessively to cause disruption.

2. Name

a. Every physical person has a name chosen by zir.

b. The name may only be changed upon application of the affected individual to the Imperial Judex or directly to the Kaiser. The Imperial Judex may only deny such application if the new name is of frivolous character, results in confusion with the name of a living denizen of Shireroth, or is for all purposes not suitable to be a name.

c. A person who uses the name of another is liable for any resulting damage or confusion.

3. Absence

a. A person who has been absent from Shireroth and the international community known as “micronations” for more than 90 days without advising a return may be declared disappeared by the Imperial Judex or the Kaiser.

b. A person declared disappeared may be declared dead by the Imperial Judex or the Kaiser in judgment upon 90 days, unless proof of death has come earlier.

4. Respect of privacy

a. Every physical person has the right to have zir privacy respected.

b. Privacy may only be invaded in accordance with law or with the affected person’s consent.

Mortis NAY.

Where does this go? Some of this feels like a bill of rights, and other parts feel like they might fit in better elsewhere. Other parts feel unclear.

Why does this feel like a bill of rights, Erik? What about it don't you like?

What is controversial with a right to life, integrity and respect for name and privacy? It doesn't say freedom of speech or assembly or anything.

Wait, is this mean to replace the Current G in Chapter VII. Laws of the Land? Which is the section on Chickens and Mooses. Or just be tucked into Chapter VII in general. In which case, can I just put it at the end?

Yes, it is to replace current G of the Laws of the Land. But we can put it somehwere else if people are up for it. I'm just killing two birds with a stone.

I think you would have a better chance of getting Andreas to support this if you didn't remove the Chicken and Mooses section with it.

I think you would have a better chance of getting me to support it if you did it in a time I had the time to set aside and properly look at the lawbook and what each proposal is fitting into. I'm loathe to vote for stuff I don't understand. Put me down as ABSTAIN for now and I'll get back to it later.

What is judicial personality, and why does this sentence not have a full stop?
1 b. Every physical person holds personality rights which are the right to life, integrity of person and the respect of zir name and privacy. These rights are in good faith; they may not be exercised with the intent to injure another or be used excessively to cause disruption.
Why are the rights held by their personality, instead of being personal rights? What does integrity of person mean? Though glad to see we're going with Mill's harm principle.


By physical person I assume you mean OOC individuals? So these rights hold no actual IC meaning?

Does this mean once they've been declared disappeared, it takes another 90 days to declare them dead? Or that any time they are eligible to be declared disappeared they may be declared dead? And what happened to the good old "Don't fill in the census twice in a row and we kick you out" clause?
