Ducal Decree XI : Regarding Deportation

Ducal Decree XI

To all persons, both Noble and Common, to whom these Presents shall come, Greetings:

WHEREAS it is Our Ducal Opinion that Our Most Magnificent Duchy of Froyalan ought to be a place of security, peace and tranquillity where individuals are safe from harassment, bullying and other forms of harm inflicted by heinous, unruly and subversive elements;

AND WHEREAS it is Our Ducal Duty to uphold the said environment of security, peace and tranquillity in which individuals are safe from harassment, bullying and other forms of harm inflicted by heinous, unruly and subversive elements;

AND WHEREAS We have always had at Our Disposal, under the Udal Law of Our Most Magnificent Duchy of Froyalan, a vast array of sweeping Powers to protect individuals from harassment, bullying and other forms of harm inflicted by heinous, unruly and subversive elements;

AND WHEREAS it is meet to formalize the said array of sweeping Powers to protect individuals from harassment, bullying and other forms of harm inflicted by heinous, unruly and subversive elements;

AND WHEREAS We have the sole and exclusive authority over all residence and entry issues concerning Our Most Magnificent Duchy of Froyalan including Power to enact legislation concerning all matters relating to residence in and entry into Our Most Magnificent Duchy of Froyalan;

AND WHEREAS We have deemed that it is, in the light of certain recent events, time to enact formal legislation concerning the matter of deportation from Our Most Magnificent Duchy of Froyalan;

LET IT THEREFORE BE KNOWN that We, Harald of Ettlingar Freyu, Duke of Froyalan, Count of Wintergleam, do by this Our Ducal Instrument, in the exercise of Our Most Ancient Prerogative Ducal, decree that:

Ein. Where We are satisfied after such inquiry or on such written information as We may consider necessary or sufficient that deportation from Our Most Magnificent Duchy of Froyalan of any person would be conducive to the good of Our Most Magnificent Duchy of Froyalan, We may, by Order, deport such person from Our Most Magnificent Duchy of Froyalan.

Tveir. Without prejudice to the generality or scope of the Powers conferred upon Us by Article Ein We may, by Order, deport any person from Our Most Magnificent Duchy of Froyalan who:

(a) with an intent prejudicial to the Security, Tranquillity or Harmony within Our Most Magnificent Duchy of Froyalan, travels into, takes up residence in, or obtains or attempts to take up residence in Our Most Magnificent Duchy of Froyalan; or

(b) posts rude, offensive, threatening, obscene, hostile or inflammatory messages on, from or via the forums of Our Most Magnificent Duchy of Froyalan; or

(c ) engages in an exchange of rude, offensive, threatening, obscene, hostile or inflammatory messages on, from or via the forums of Our Most Magnificent Duchy of Froyalan; or

(d) with commercial or malicious intent, floods the forums of this Most Magnificent Duchy of Froyalan with unsolicited, unwanted, or unwelcome messages, or does the same from or via the forums of Our Most Magnificent Duchy of Froyalan; or

(e) says, writes, prints, utters or publishes any untruthful words that cause someone to be shamed, ridiculed, held in contempt, lowered in the estimation of the community, or otherwise suffer a damaged reputation; or

(f) uses the name of another person with the intent of causing deception or defamation of character; or

(g) in order to cause a mistake of another person, uses a name, or declares to have a character, that is not his own; or

(h) intends, attempts, conspires or makes preparations to detach a part of Our Most Magnificent Duchy of Froyalan by violent or other unlawful means or with foreign assistance; or

(i) intends, attempts, conspires or makes preparations to bring Our Most Magnificent Duchy of Froyalan or any part thereof under the subjection of an outside power by violent or other unlawful means or with foreign assistance; or

(j) intends, attempts, conspires or makes preparations to render Our Most Magnificent Duchy of Froyalan dependent on an outside power by violent or other unlawful means or with outside assistance; or

(k) intends, attempts, conspires or makes preparations to depose Us or any of Our Counts by violent or other unlawful means or with outside assistance; or

(l) usurps or unlawfully exercises any function of government, whether by setting up, maintaining or taking part in any way in a body of persons purporting to be a government or a legislature but not authorised in that behalf by or under the Laws of Our Magnificent Duchy of Froyalan, or by setting up, maintaining, or taking part in any way in a purported Law Court or other tribunal not lawfully established, or by forming, maintaining, or being a member of an armed force or a purported police force not so authorised, or by any other action or conduct whatsoever; or

(m) prevents or obstructs, or attempts or is concerned in an attempt to prevent or obstruct, by force of arms or other violent means or by any form of intimidation the carrying on of any branch (whether Legislative, Judicial, or Executive) of Our Ducal Government or the exercise or performance by any member of the legislature, the judiciary, or the executive or by any of Our officers or employees (whether civil (including police) or military) of any of their functions; or

(n) prevents, or obstructs, or attempts or is concerned in an attempt to prevent or obstruct Us , by force of arms or other violent means or by any form of intimidation the exercise or performance of any of Our functions, powers, or duties; or

(o) unlawfully prevents, or obstructs, or attempts or is concerned in an attempt to prevent or obstruct any of the Counts of Froyalan, by force of arms or other violent means or by any form of intimidation the exercise or performance of any of their functions, powers, or duties; or

(p) promotes feelings of ill-will between different classes or groups of Residents of Our Most Magnificent Duchy of Froyalan so as to endanger the peace, order and good government within Our Most Magnificent Duchy of Froyalan; or

(q) makes rude, offensive, threatening, abusive or other vexatious comments towards an individual or behaves himself in such a fashion towards an individual on, from or via the forums of Our Most Magnificent Duchy of Froyalan that is known or ought reasonably be known to be unwelcome that causes substantial emotional distress in such individual and serves no legitimate purpose.

Thrír. Every person deported from Our Most Magnificent Duchy of Froyalan under this Our Ducal Instrument is hereby prohibited from entering or residing in Our Most Magnificent Duchy of Froyalan for either for the term of his natural life or for such other term as may be specified in the Deportation Order issued against him so long as the term for which he has been prohibited from entering or residing in Our Most Magnificent Duchy of Froyalan has not expired or the deportation order has not been cancelled or revoked, and whether or not the order has been executed provided always We may in Our absolute discretion exempt any person deported from Our Most Magnificent Duchy of Froyalan from the prohibition contained in this Article.

Fjórir. We may at any time revoke or suspend any deportation order made under this Our Ducal Instrument.

Fimm. In this Our Ducal Instrument "person" shall refer to anyone not the Kaiser of Shireroth or the Steward of Shireroth when serving as head of state.

Sétt. This Our Ducal Instrument shall come into effect immediately.
