Articles of Confederation (Hau’oli ‘Ena)

It doesn't happen much, but once in a year the original 'Articles of Confederation' are shown to public in the old Iolani Palace. It remembers the people of their past, and that's something that can always reckon on enthusiasm from a good Kildarian.
ARTICLES OF CONFEDERATION

Article I.

Hau’oli ‘Ena shall be a confederation composed of self governing communes. The Confederation of Communes shall be titled the Confederation of Hau’oli ‘Ena.

Article II.

Each communes retains its sovereignty, freedom and independence, and every power, jurisdiction and right, which is not by this Confederation expressly delegated to the Confederation of Hau’oli ‘Ena.

Article III.

The said communes hereby severally enter into a firm league of friendship with each other, for their common defense, the security of their liberties, and their mutual and general welfare, binding themselves to assist each other, against all force offered to, or attacks made upon them, or any of them, on account of religion, sovereignty, trade, or any other pretence whatever. The communes shall become one nation.

Article IV.

Each commune is to follow the Constitution and national law of the Confederation of Hau’oli ‘Ena. No commune can do anything that violates national law or policy. This applies to territories as well.
Natural rights must be guaranteed in each commune and territories. No commune has the jurisdiction to be supreme over the national government. A fair and just trial must be given in each commune and territory and all rights guaranteed by the Bill of Rights must be observed.

Article V.

Each commune must be given proportional representation in the Anaina by the following election system.
Each commune shall elect one representative to Anaina. This is the leading vote receiver from that Commune, as voted on by the residents of that Commune only.
For every 5 votes counted, the leading candidate as elected by all the people of Hau’oli ‘Ena will be elected.
Each territory has the right to send one representative to Anaina, but cannot vote in the election of additional representatives.

Article VI.

No commune, without the consent of the national government, shall send any embassy to, or receive any embassy from, or enter into any conference, agreement, or alliance or treaty with any other foreign commune or nation; nor shall any person holding any office or government position in Hau’oli ‘Ena or their commune, accept any present, emolument, office or title of any kind whatever from any king, prince or foreign commune; nor shall anyone grant any title of nobility to any citizen of Hau’oli ‘Ena.
No two or more communes shall enter into any treaty, confederation or alliance whatever between them, without the consent of the national government, specifying accurately the purposes for which the same is to be entered into, and how long it shall continue.
No commune shall lay any imposts or duties, which may interfere with any stipulations in treaties, entered into by the national government.
War must be engaged as a national entity. No commune shall engage in any war without the consent of the national government.

Article VII.

A citizen of Hau’oli ‘Ena may only be a registered voter official resident of one (1) commune at a time. He/she may freely switch commune residence, but must notice the Department of the Interior of the switch and the move must be recognized by each commune.
A territorial resident must also follow the same rules, and cannot move to a commune unless applying and receiving full citizenship to the Confederation.
No Commune can deny a citizen a right to leave that commune.
A citizen must be a resident of a commune at all times. In any case that residency is not declared, the citizenship is considered to live in the Capital of the Confederation, Poha’ku Kuoko’a, but is not represented in government.

Article VIII.

The Confederation as an entity shall adapt a national currency. The creation of other currencies is prohibited. The Treasury shall also be on a national level. The Secretary of the Treasury must approve new economic institutions on all levels.

Article IX.

It shall be clear that the national government of the Confederation, shall have the sole and exclusive right and power on all matters as it see fit and is bound by the law of Hau’oli ‘Ena. Communes must support the decisions and rulings of the supreme government, and the results of national elections and referenda.

Article X.

The defense of the Confederation of Hau’oli ‘Ena shall be on a national level, and not be the responsibility of individual communes. Commune defenses must support the national cause. Communes cannot create their own defenses.
This also applies to territories. The defense of territories is the responsibility of the national defense.

Article XI.

No territories or communes may be added to the Confederation without the approval of the Anaina. A commune or territory must meet the requirements of two residents and a minimally sized website to be considered to be added to the Confederation as a commune or territory.
Territories are protectorates under the influence or government of the Confederation of Hau’oli ‘Ena. Territorial citizens are not full citizens of Hau’oli ‘Ena, but each territory is guaranteed a representative in the Anaina and the national rights and procedures guaranteed by the Constitution and Law of the Confederation.

Article XII.

Poha’ku Kuoko’a shall be the permanent capital of the Confederation of Hau’oli ‘Ena. It shall receive no representation because it has no citizens or legal residents. It is rather the home of the government and all government functions.

Article XIII.

These articles shall be observed and followed by all communes and territories of the Confederation of Hau’oli ‘Ena.
Amendments to these articles can only take place by a national referendum receiving a 60% vote in favor the amendment.

Article XIV.

A commune or territory is allowed to secede baring that 60 percent of the residents of that commune support secession and citizens not wishing to leave the Confederation be allowed to move to a new commune.
The National Government has the right to deny session if it suspects that infiltration led to the secession. The Supreme Justice and High Court will participate in this decision.
